ផែនទីសម័យបារាំង ខ្មែរនិងសៀម

 តើកម្ពុជា អាចនឹងប្រឈមអ្វីខ្លះ បើលុប MoU ឆ្នាំ២០០០? 

១.កម្ពុជាមិនអាចលុប MoU ឆ្នាំ២០០០ទេ ព្រោះ MoU នេះ បានចងថៃភ្ជាប់ជាមួយអនុសញ្ញា និងសន្ធិសញ្ញាបារាំងសៀមឆ្នាំ១៩០៤ និងឆ្នាំ១៩០៧ ហើយអ្វីដែលសំខាន់បំផុតនៅក្នុង MoU នេះ គឺសង្កត់កថៃឱ្យជាប់ជាមួយផែនទី ដែលគូសដោយគណៈកម្មាធិការព្រំដែនចម្រុះបារាំងសៀមឆ្នាំ១៩០៨ ខ្នាត១/២០០.០០០។

២.MoU ឆ្នាំ២០០០ បានការពារអនុសញ្ញា និងសន្ធិសញ្ញាបារាំងសៀមឆ្នាំ១៩០៤ និង១៩០៧ យ៉ាងរឹងមាំ និងបានការពារអធិបតេយ្យភាពកម្ពុជាពីមហិច្ឆតាឈ្លានពានរបស់ថៃមកលើប្រាសាទព្រះវិហារ និងតំបន់ផ្សេងទៀតនៅតាមបណ្តោយព្រំដែន។

៣.បើកម្ពុជាលុបចោល MoU ឆ្នាំ២០០០ ប្រៀបបាននឹងលុបចោលសន្ធិសញ្ញាបារាំងសៀមឆ្នាំ១៩០៤ និង១៩០៧ តើកម្ពុជានឹងយកសន្ធិសញ្ញា និងផែនទីណាមកចរចាជាមួយសៀម?

៤.ចេតនារបស់សៀមចង់លុប MoU ឆ្នាំ២០០០ គឺមិនចង់ទទួលស្គាល់សន្ធិសញ្ញាបារាំងសៀមឆ្នាំ១៩០៧ ព្រោះសៀមធ្លាប់បានលើកឡើងកន្លងមកហើយថា សន្ធិសញ្ញាបារាំងសៀមឆ្នាំ១៩០៧ គឺសៀមធ្វើជាមួយបារាំង ពុំមែនធ្វើជាមួយកម្ពុជាទេ ដូច្នេះសៀមពុំដែលមានសន្ធិសញ្ញាព្រំដែនជាមួយកម្ពុជាទេ។(ស្អីក៏សៀមអាចនិយាយចេញដែរ)

៥.បើលុប MoU នេះបានសម្រេចសៀម ប្រើប្រាស់ផែនទីឯកតោភាគី ខ្នាត១/៥០.០០០ របស់ខ្លួន រួចឈ្លានពានយកតំបន់ប្រាសាទព្រះវិហារ និងតំបន់ផ្សេងទៀតជាច្រើននៅតាមបណ្តោយព្រំដែនខ្មែរសៀម។

ហ៊ីម! ពិតជាពិបាកណាស់ផ្ទះយើងមានរបងជាប់ផ្ទះចោរ ទោះបីធ្វើរបងខ្ពស់យ៉ាងណាក៏វានៅតែលួច ជី ស្លឹកគ្រៃ ម្ទេសនៅមុខផ្ទះដែរ ! តែបើវាអត់អីលួយសោះក៏វាជុះនោមដាក់របងយើងដែរ។

What Challenges Might Cambodia Face if It Cancels the 2000 MoU?

1. Cambodia cannot simply annul the 2000 MoU, because this agreement is intrinsically linked to the Franco–Siamese Treaties of 1904 and 1907. Most importantly, the MoU binds Thailand to the map drawn by the Franco–Siamese Mixed Commission of 1908, at a scale of 1:200,000.

2. The 2000 MoU provides strong protection for the Franco–Siamese Treaties of 1904 and 1907 and safeguards Cambodia’s sovereignty against Thailand’s expansionist ambitions, particularly with respect to Preah Vihear Temple and other areas along the border.

3. If Cambodia cancels the 2000 MoU, it would be tantamount to canceling the Franco–Siamese Treaties of 1904 and 1907. In such a case, with what treaties and maps could Cambodia negotiate with Siam?

4. Siam’s underlying intention in seeking to nullify the 2000 MoU is its refusal to recognize the Franco–Siamese Treaty of 1907. Siam has previously argued that this treaty was concluded with France, not with Cambodia. Therefore, Siam claims that it has never entered into a boundary treaty with Cambodia. (This is the type of argument Siam could potentially put forward.)

5. If Siam succeeds in having the MoU annulled, it could then employ its own unilateral 1:50,000 scale maps to justify encroachment and seize the Preah Vihear Temple area along with numerous other zones along the Khmer–Siamese frontier.

Indeed, it is extremely difficult for our house to share a fence with a thief. No matter how high we build the fence, he will still steal our bananas, lemongrass, and chilies from the front yard. And even if he refrains from stealing, he will still urinate against our fence.
